By accessing or using PM Coach at pmcoach.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and PM Coach ("we," "our," or "us").

2. Description of Service

PM Coach is an AI-powered stakeholder communication coaching platform for project, program, and product managers. The Service provides simulated stakeholder conversations, real-time coaching feedback, session reports, skills tracking, and related features as described on our website.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

4. Subscription Plans and Payments

PM Coach offers both free and paid subscription plans. Paid plans are billed according to the pricing displayed at the time of purchase.

Free Plan: Limited to 3 coaching sessions per month with access to starter scenarios
Paid Plans: Provide additional sessions, features, and capabilities as described on our pricing page
Billing: Paid subscriptions are billed monthly. Payment is processed by Stripe.
Cancellation: You may cancel your subscription at any time. Access continues through the end of your current billing period.
Refunds: Subscription fees are generally non-refundable. Contact support@pmcoach.app for exceptional circumstances.

5. Credits and Usage

Each plan includes a specific number of coaching session credits per billing period. Credits reset at the beginning of each billing cycle and do not roll over. Unused credits expire at the end of each billing period.

6. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Transmit harmful, offensive, or inappropriate content
Attempt to circumvent usage limits or security measures
Use the Service for purposes other than professional development and communication coaching
Share your account credentials with others or allow unauthorized access
Reverse-engineer, decompile, or attempt to extract the source code of the Service
Automate access to the Service or use bots, scrapers, or similar tools

7. AI-Generated Content

The coaching feedback, session reports, stakeholder simulations, and other AI-generated content provided by the Service are for educational and professional development purposes only. They should not be considered professional advice. AI-generated content may contain inaccuracies. You are responsible for your own professional decisions and communications.

8. Intellectual Property

The Service, including its design, features, content, scenarios, frameworks, and underlying technology, is owned by PM Coach and protected by intellectual property laws. You retain ownership of content you create through the Service (e.g., custom scenarios, artifact drafts). You grant us a license to process your content to provide the Service.

9. Team Plans

If you purchase a Team plan, the team administrator is responsible for managing team members and ensuring compliance with these Terms. Team administrators may view aggregated performance metrics for their team members. Individual coaching session transcripts are not shared with team administrators.

10. Limitation of Liability

To the maximum extent permitted by law, PM Coach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or other intangible losses resulting from your use of the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that the AI-generated coaching feedback will be accurate or suitable for any particular purpose.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
